Terms and Conditions
These Terms and Conditions (hereinafter referred to as "Agreement") govern the use of the curriculum and all associated materials (hereinafter referred to as "Curriculum") provided by Thrive Together through the Learning Management System (hereinafter referred to as "LMS"). By accessing or using the Curriculum on the LMS, you agree to abide by the terms and conditions set forth below:
1. Access and Use
1.1.1 Access to the Curriculum is granted solely to authorized users, including teachers, students, and administrators of the subscribing school.
1.1.2 Access to the Free Resources Library is granted to all subscribing individuals.
1.2. Users are responsible for maintaining the confidentiality of their login credentials and ensuring their accounts are not accessed by unauthorized individuals.
2. Intellectual Property Rights
2.1. The Curriculum and all associated materials, including but not limited to texts, images and videos, are the intellectual property of Thrive Together, and are protected by copyright laws.
2.2. Users are granted a non-exclusive, non-transferable license to use the Curriculum solely for educational purposes within the subscribing school.
2.3. Users may not copy, reproduce, modify, distribute, or publicly display any part of the Curriculum without prior written consent from Thrive Together.
3. Restrictions
3.1. Users shall not engage in any activity that could disrupt the functionality of the LMS or compromise the security of the Curriculum.
3.2. Users shall not upload, share, or distribute any content that is illegal, defamatory, infringing on intellectual property rights, or violates any applicable laws or regulations.
3.3. Users shall not attempt to reverse engineer, decompile, or disassemble any part of the LMS or Curriculum.
4. Privacy and Data
4.1. Thrive Together is entitled to collect and process user data in accordance with applicable privacy laws and its Privacy Policy, a copy of which is available on the LMS.
4.2. Users are responsible for safeguarding their personal information and complying with the Thrive Together's privacy policies.
5. Termination
5.1. Thrive Together reserves the right to terminate or suspend access to the Curriculum and LMS at its sole discretion, without notice, in cases of violations of this Agreement or any applicable laws.
5.2. Upon termination, users must cease all use of the Curriculum and remove any downloaded or printed materials.
6. Disclaimer of Warranties
6.1. The Curriculum is provided for the purpose of teaching Diversity, Equity, Inclusion, Belonging and Justice, but Thrive Together gives no warranties as to its suitability in any particular context.
7. Limitation of Liability
7.1. To the extent permitted by law, Thrive Together shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the Curriculum or LMS.
8. Governing Law
8.1. This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa.

By accessing and using the Thrive Together Curriculum on the LMS, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
